Welcome to MyTshong. These Terms and Conditions ("Terms") govern your use of the MyTshong point-of-sale and inventory management software ("Service") provided by WONS (Web-enabled On-demand Network Services) ("we," "us," or "our").
By accessing or using MyTshong, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
To use MyTshong, you must:

You must create an account to use MyTshong. You agree to provide accurate, current, and complete information during registration.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
4.3 Account Responsibility
You are solely responsible for all data, content, and activity associated with your account.

MyTshong offers various subscription plans. Details of features and pricing are available on our website.
5.2 Payment Terms
5.3 Free Trial
We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

While we perform regular backups, you are responsible for maintaining your own backup copies of critical business data.
7.4 Privacy Policy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
7.5 Data Retention
Upon termination of your account, we will retain your data for 30 days, after which it may be permanently deleted.
8.1 Tax Compliance
You are solely responsible for ensuring compliance with all applicable Bhutanese tax laws, including Bhutan Sales Tax (BST) and income tax regulations. MyTshong provides tools to assist with tax reporting, but does not provide tax advice.
8.2 Business Licensing
You must maintain all necessary business licenses and permits required to operate your business in Bhutan.
8.3 Record Keeping
You must maintain accurate business records as required by Bhutanese law.
9.1 Our Rights
MyTshong, including all software, features, designs, and content, is owned by WONS and protected by intellectual property laws. These Terms do not grant you any ownership rights to the Service.
9.2 License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use MyTshong for your business purposes.
9.3 Feedback
If you provide suggestions or feedback about MyTshong, we may use such feedback without any obligation to you.
10.1 Service Uptime
While we strive to maintain 99.9% uptime, we do not guarantee uninterrupted access to the Service.
10.2 Maintenance
We may perform scheduled or emergency maintenance, which may temporarily affect Service availability. We will provide reasonable notice for scheduled maintenance.
10.3 Support
Support is provided during business hours (9:00 AM to 5:00 PM Bhutan Standard Time, Monday through Friday, excluding Bhutanese public holidays).
11.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
11.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.
11.3 Maximum Liability
Our total liability to you for all claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless WONS, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of MyTshong after such modifications constitutes acceptance of the updated Terms.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice.
16.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Bhutan.
16.2 Jurisdiction
Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Thimphu, Bhutan.
16.3 Dispute Resolution
Before filing any legal claim, you agree to attempt to resolve disputes through good-faith negotiation with us.
17.1 Entire Agreement
These Terms constitute the entire agreement between you and WONS regarding the Service.
17.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
17.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, civil unrest, government actions, or internet/telecommunications failures.
